Türkiye Cumhuriyeti Hazine ve Maliye Bakanligt Mali Suçlari Arastirma Kurulu Baskanhgi (MASAK) ile Çin Halk Cumhuriyeti Hong Kong Özel Idare Bölgesi Ortak Mali Istihbarat Birimi (JFIU), (bundan böyle "Yetkili Makam" veya birlikte "Yetkili Makamlar" olarak anlacaklardir),

Isbirligi ve karsilikli menfaat anlayisi içinde, ülkelerindeki yetkili makamlar tarafindan sorusturma ve kovusturma baslatilmasi ile sonuçlanabilecek bilgi paylasimi amaciyla süpheli karapara aklama, baglantili öncül suçlar ve terörizmin finansmani ile ilgili analizlerin kolaylastirilmasin isteyerek;

Ilgili Egmont Grubu belgelerini, özellikle "Sarti"ni ve "Mali Istihbarat Birimleri Arasinda Bilgi Paylasum Prensipleri"ni göz önünde bulundurarak;

Her birinin ülkesinde geçerli olan kanunlar ve düzenlemeler çerçevesinde;

Asagidaki sekilde anlasmaya varmislardir.

Amaç

1. Yetkili Makamlar, süphelenilen karapara aklama, baglantili öncil suçlar ve terörizmin finansmanina iliskin bilgilerin toplanmasi, gelistirilmesi ve analizinde isbirligi yapacaklardir.
2. Yetkili Makamlar, mütekabiliyet ilkesine dayali olarak, mevcut ve elde edilebilir en genis kapsamdaki bilgileri kendiliginden ya da talep üzerine serbestçe paylasacaklardir.
3. Bu Mutabakat Muhtirasi'nin yorumlanmasinda ve uygulanmasinda, Yetkili Makamlar Egmont Grubu belgelerine, özellikle "Sarti"na ve "Mali Istihbarat Birimleri Arasinda Bilgi Paylasim Prensipleri"'ne basvurabilirler. Yetkili Makamlar, bu Mutabakat Muhtirasi'nin kapsami disinda kalan hususlarla ilgili olarak Egmont Grubu belgelerine basvurabilirler.
4. Bu Mutabakat Muhtirasi'nin amaci Yetkili Makamlar arasindaki isbirliginin arttirilmas1 ve gelistirilmesidir. Bu Mutabakat Muhtirasi Yetkili Makamlar'in uzlasmasini temsil etmekte olup, Yetkili Makamlar için yasal olarak baglayici hiçbir yükümlülük ya da karsilkli hak dogurmasi amaçlanmamaktadir.
5. Bu Mutabakat Muhtirasi'nn isleyisi ülkelerin kendi ulusal kanun ve düzenlemelerine tabidir.

Talepte Bulunma

1. Taleplerin zamaninda ve etkin bir sekilde yerine getirilebilmesi için Yetkili Makamlar, bilgi talebinde analiz edilen olaya iliskin açiklama, olayin talepte bulunulan ülke ile olan muhtemel baglantisi ve taleple ilgili herhangi bir aciliyetin olup olmadigina dair bilgi de dahil gerçeklere dayali baglantili bilgiler ile hukuki bilgileri vermek için azami gayreti gösterecektir.
2. Yetkili Makamlar talebin nedenlerini, (varsa) talebin hangi kurum adina gönderildigini ve mümkün oldugu ölçüde talebe istinaden edinilecek bilgilerin ne amaçla kullanilacagini belirteceklerdir.
3. Talepte bulunulan Yetkili Makam talep içeriginde yer alan bilgileri, talebin yerine getirilmesi için gerekli olmasi ya da talepte bulunan Yetkili Makamin önceden yazili izin vermesi halleri disinda üçüncü taraflara ya da talepte belirtilen amaçlar disinda açiklamayacaktir.

Cevaplar

1. Talepte bulunulan Yetkili Makam talebi aldigini bildirecek ve talebe zamaninda cevap verecektir. Talebe cevabin tam olarak verilmesinin gecikebilecegi durumlarda, talepte bulunulan Yetkili Makam talebe geçici veya kismi cevabi zamaninda vermek için azami gayreti gösterecektir.
2. Talepte bulunulan Yetkili Makam, mütekabiliyete dayali olarak, talepte bulunan Yetkili Makam adina arastimalar yapacak ve bu arastirmalar yurt içinde yapilmissa, elde edebilecegi bütün bilgileri verecektir. Bilhassa, Yetkili Makamlar yurt içi analizler için dogrudan veya dolayh olarak elde etme veya erisme yetkilerinin oldugu tüm bilgileri saglayacaktir.

Bilgilerin Kullanilmasi ve Açiklanmast

1. Bu Mutabakat Muhtirasi kapsaminda yapilan bir talebe istinaden saglanan bilgilerin kullanilmasi asagidaki sinirlamalara tabidir:
2. (b) Talepte bulunan Yetkili Makam, talepte bulunulan Yetkili Makamdan alinan bilgileri, önceden kendisinden yazil izin alinmadikça, talepte belirtilmeyen herhangi bir tarafla paylasmayacaktir.
3. (a) Talepte bulunan Yetkili Makam bilgileri bu Mutabakat Muhtirasi'nda belirtilen veya talepte bulunulan Yetkili Makam tarafindan kabul edildigi sekilde talepte belirtilen amaçlar disinda kullanmayacaktir;

4. (c) Talepte bulunan Yetkili Makam, talepte bulunulan Yetkili Makamdan alinan bilgileri idari, kovusturma veya adli yargilama islemleri dahil olmak üzere herhangi bir islemde delil olarak kullanmayacaktir. Bu tür bilgiler yalnizca istihbarat amaciyla kullanlacaktir.

5. Talepte bulunan Yetkili Makam bilgilerin talepte bulunulan Yetkili Makamdan önceden yazili izin alinmadikça baska herhangi bir tarafa açiklanamayacagini ve bilgilerin herhangi bir islemde delil olarak kullanlamayacagini kolluk makamlarina bildirmek için bilgi talebinde belirtilen kolluk makamlarina saglanan her türlü bilgiye uyan notlari ekleyecektir.

6. Talepte bulunan Yetkili Makam, diger Yetkili Makamdan aldigi bilgileri kanun geregi açiklamakla yükümlü ise, diger Yetkili Makami derhal haberdar edecek ve bilgileri açiklamak için yazil iznini isteyecektir. Yazili iznin verilmemesi durumunda talepte bulunan Yetkili Makam bilgilerin herhangi bir üçüncü tarafa açiklanmamasini veya açiklamaya uygun sinirlamalar getirilmesini saglamak için makul gayret gösterecektir. Yazili izin talepte bulunulan Yetkili Makam tarafindan makul olmayan nedenlerle reddedilmeyecektir.

Geribildirim

1. Talep üzerine ve mümkün oldugunda, bir Yetkili Makam verilen bilgilerin kullanimi ve bu bilgilere dayali olarak gerçeklestirilen analizin sonuçlan hakkinda diger Yetkili Makama geribildirim saglayacaktir.

Gizlilik

1. Bu Mutabakat Muhtrasi kapsaminda edinilen bilgiler gizlidir. Bu bilgiler, bilgiyi alan Yetkili Makamin ulusal kanun ve düzenlemelerinde resmi sirlara ve gizli bilgilere uygulananlara benzer korumaya tabi olacaktir.

Talebin Reddi

1. Talepte bulunulan Yetkili Makam, talep edilen bilgilerin verilmesinin kendi ülkesindeki bir sorusturma veya adli islemi olumsuz etkileyebilecegine ya da kendi ulusal kanun ve düzenlemeleri geregince bu bilgilerin verilmesinin yasaklanmis olduguna karar verirse talepte bulunan Yetkili Makama bilgi vermeyi reddedebilir.

2. Talepte bulunulan Yetkili Makam asagidaki durumlarda bilgi vermeyebilecektir:

(a) Bilgi talebinde iddia olunan ayni eylemlere veya ihmal durumlarna iliskin olarak bilgi talebinde bulunulan Yetkili Makamin ülkesinde halihazirda baslatilmis adli yargilamanin bulunmas1

(b) Bu tür bilgilerin verilmesinin Çin Halk Cumhuriyeti'nin egemenligine veya Çin Halk Cumhuriyeti veya onun herhangi bir parçasinin güvenligine veya kamu düzenine veya Çin Halk Cumhuriyeti Hong Kong Ozel Idare Bölgesi'nin asli çikarlanna zarar verme ihtimalinin olmasi veya,

(c) Bu tür bilgilerin verilmesinin Türkiye Cumhuriyeti'nin egemenligine, güvenligine, kamu düzenine veya asli çikarlanna zarar verme ihtimalinin olmasi.

1. Talepte bulunulan Yetkili Makamin bir talebe cevap vermeme karari almasi durumunda bu durum talep bulunan Yetkili Makama gerekçeleriyle birlikte bildirilecektir.

2. Yetkili Makamlar yardimda bulunmayi asagidaki gerekçelerle reddetmeyeceklerdir:

3. (a) Talep vergileme konulariyla ilgili olmasi;
4. (b) Talep bankacilik sirr ile ilgili olmasi; veya
5. (c) Talepte bulunan Yetkili Makamin mahiyeti veya statüsü ile ilgili olmas1.

iletisim ve Prosedürler

1. Bilgi paylasimlari güvenli bir sekilde ve güvenilir kanallar ya da mekanizmalar vasitasiyla yapilacaktir. Bu amaçla Yetkili Makamlar Egmont Güvenli Agi'ni veya asgari olarak Egmont Güvenli Agi'nin sagladigia esdeger güvenlik, güvenilirlik ve etkililik seviyesi saglayan ve Yetkili Makamlar tarafindan kabul edilen diger yollari kullanacaklardir.
2. Yetkili Makamlar, bu Mutabakat Muhtirasi'nin uygulanmasi amaci ile her bir ülkenin mevzuatina uyumlu olarak kabul edilebilir iletisim prosedürleri için müsterek düzenleme yapacaklar ve birbirleri ile istisarede bulunacaklardir.
3. Yetkili Makamlar arasindaki iletisim, mümkün oldugunca Ingilizce dilinde gerçeklestirilecektir.
4. Mümkün oldugu ölçüde, tüm bilgi talepleri, bilgi taleplerine verilen cevaplar, bilgi paylasimlari, bildirimler ve bu Mutabakat Muhtirasi uyarinca verilen izinler yazili olacaktir.

isbirliginin Gelistirilmesi

1. Yetkili Makamlar, karapara aklama ve terörizmin finansmanmin önlenmesi, tespiti ve caydirilmasina iliskin olarak aralarnda isbirligi yapabilecekleri diger alanlari müzakere edeceklerdir.

Degisiklikler

1. Bu Mutabakat Muhtirast karsilikli yazali riza ile her zaman degistirilebilir. Yetkili Makamlar, bu degisikliklere dair onaylarni karsilkli olarak yazil sekilde bildireceklerdir. Degisiklikler son bildirim tarihinde yürürlüge girecektir.

Fesih

1. Bu Mutabakat Muhtirasi, diger Yetkili Makama yazili olarak bildirilmek suretiyle, her zaman feshedilebilir. Fesih, diger Yetkili Makamdan yazili bildirimin alinmasindan itibaren yürürlüge girecektir.

2. Bu Mutabakat Muhtirasinin feshi, bu fesihten önce ya da fesih tarihinde bu Muhtiradan kaynaklanan veya bu Muhtiraya bagli olan hak ve yükümlülüklere halel getirmeyecektir Bu Mutabakat Muhtirasi'nn feshinden önce alinan bilgilerin gizliligini temin eden hükümler, Mutabakat Muhtirasi'nin fesih olmasindan sonra da yürürlükte kalacaktir.

Yürürlük Tarihi

1. Yetkili Makamlarn her biri bu Mutabakat Muhtirasi'nin onaylandigini yazili olarak diger Yetkili Makama bildireceklerdir. Bu Mutabakat Muhtirasi son bildirim tarihinde yürürlüge girecektir.

Bu Mutabakat Muhtirast Hong Kong ve Türkiye'de asagida belirtilen tarihte Ingilizce dilinde iki suret olarak imzalanmistir.

MEMORANDUM OF UNDERSTANDING BETWEEN

THE MINISTRY OF TREASURY AND FINANCE, FINANCIAL CRIMES INVESTIGATION BOARD (MASAK) OF THE REPUBLIC OF TURKEY AND

THE JOINT FINANCIAL INTELLIGENCE UNIT (JFIU) OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION OF THE

PEOPLE'S REPUBLIC OF CHINA CONCERNING COOPERATION IN THE EXCHANGE OF FINANCIAL INTELLIGENCE RELATED TO MONEY LAUNDERING, ASSOCIATED PREDICATE OFFENCES AND TERRORISM FINANCING

The Ministry of Treasury and Finance, Financial Crimes Investigation Board (MASAK) of the Republic of Turkey and The Joint Financial Intelligence Unit (JFIU) of the Hong Kong Special Administrative Region of the People's Republic of China (hereinafter each referred to as an "Authority" or collectively as the "Authorities"),

Desiring, in a spirit of cooperation and mutual interest, to facilitate analysis concerning cases of suspected money laundering, associated predicate offences and terrorism financing, with a view to disseminating information which may ultimately result in investigations and prosecutions by competent authorities in their respective jurisdictions;

Having regard to the relevant documents of the Egmont Group, particularly, the "Charter" and the "Principles for Information Exchange between Financial Intelligence Units";

Pursuant to prevailing laws and regulations in their respective jurisdictions.

Have reached the following understanding.

Objective

1. The Authorities will cooperate to assemble, develop and analyse information related to suspected money laundering, associated predicate offences and terrorism financing.
2. The Authorities will, based on reciprocity, freely, spontaneously or upon request exchange the widest range of information available or obtainable.
3. In interpreting and implementing this Memorandum, the Authorities may make reference to the documents of the Egmont Group, particularly the "Charter" and the "Principles for Information Exchange between Financial Intelligence Units". The Authorities may refer to the documents of the Egmont Group in considering issues which are not covered in this Memorandum.
4. This Memorandum is intended to enhance and develop cooperation between the Authorities. This Memorandum represents the understanding of the Authorities and is not intended to create any legally binding obligations or corresponding rights for the Authorities.
5. The operation of this Memorandum is subject to the laws and regulations of their respective jurisdictions.

Making Request

1. To enable a timely and efficient execution of the request, the Authorities will make their best efforts to provide in the request relevant factual and legal information, including the description of the case being analysed, the potential link with the requested jurisdiction and any need for urgency.
2. The Authorities will provide the reasons for the request, the parties (if any) on behalf of whom the request is sent and, to the extent possible, the purpose of use of the information obtained pursuant to the request.
3. The requested Authority will not disclose the information contained in the request to third parties or for purposes not identified in the request, except to the extent necessary for executing the request or with the prior written consent of the requesting Authority.

Responses

1. The requested Authority will acknowledge receipt of the request and will respond to such request in a timely manner. If delay in providing a full response is anticipated, the requested Authority will use its best efforts to provide interim or partial response in a timely manner.
2. The requested Authority will, on the basis of reciprocity, conduct queries on behalf of the requesting Authority and provide all information that they would be able to obtain if such queries were carried out domestically. In particular, the Authorities will provide all information that the Authorities have the power to obtain or access, directly or indirectly, for their domestic analysis.

Use and Disclosure of Information

1. Use of any information supplied pursuant to a request made under this Memorandum is subject to the following limitations:
2. (b) the requesting Authority will not share the information received from the requested Authority with any party not identified in the request, unless the prior written consent of the requested Authority is obtained. Any refusal to provide prior written consent will be explained and the Authorities will consult each other to explore alternative ways; and
3. (a) the requesting Authority will not use the information for purposes other than those stated in this Memorandum or set forth in the request as accepted by the requested Authority;
4. (c) the requesting Authority will not use the information received from the requested Authority as evidence in any proceedings, including administrative, prosecutorial or judicial proceedings. Such information is to be used for intelligence purposes only.
5. The requesting Authority will include warning notices on any information that it provides to the law enforcement agencies identified in the request for information, in order to place the law enforcement agencies on notice that the information cannot be disclosed to any other party unless the prior written consent of the requested Authority is obtained, and that the information cannot be used as evidence in any proceedings.
6. If the requesting Authority is required by law to disclose information it has received from the other Authority, the requesting Authority will immediately notify and seek the written consent of the other Authority to disclose the information. If written consent has not been provided, the requesting Authority will make reasonable efforts to ensure that the information will not be disclosed to any third party or that appropriate limitations are placed upon the disclosure. Written consent will not be unreasonably withheld by the requested Authority.

Feedback

1. Upon request and whenever possible, an Authority will provide feedback to the other Authority on the use of the information provided, as well as on the outcome of the analysis conducted, based on the information provided.

Confidentiality

1. The information acquired under this Memorandum is confidential. It will be subject to similar protection as applicable to official secrets and confidential information as provided by the domestic laws and regulations of the receiving Authority.

Refusals

1. The requested Authority may refuse to provide information to the requesting Authority if the requested Authority determines that release of the information requested may adversely affect an investigation or proceeding in its jurisdiction or is otherwise prohibited by its domestic laws and regulations.

2. The requested Authority may not provide information -

3. (b) if provision of such information would be likely to impair the sovereignty of the People's Republic of China, or the security or public order of the People's Republic of China or any part thereof, or essential interests of the Hong Kong Special Administrative Region of the People's Republic of China; or
4. (a) if judicial proceedings have been initiated in the jurisdiction of the requested Authority in relation to the same acts or omissions alleged in the request for information;
5. (c) if provision of such information would be likely to impair the sovereignty, security, public order or essential interests of the Republic of Turkey.
6. If the requested Authority decides not to respond to a request, it will notify the requesting Authority of its decisions with reasons.
7. The Authorities will not refuse to provide assistance on the following grounds:
8. (a) the request is related to fiscal matters;
9. (b) bank secrecy; or
10. (c) the nature or status of the requesting Authority.

Communication and Procedures

1. Exchanges of information will take place in a secure way and through reliable channels or mechanisms. For this purpose, the Authorities will use the Egmont Secure Web or other ways accepted by the Authorities that ensure equivalent levels of security, reliability and effectiveness.
2. The Authorities will jointly arrange, consistent with the laws and regulations of their respective jurisdictions, for acceptable procedures of communication and will consult each other with the purpose of implementing this Memorandum.
3. Communication between the Authorities will as far as possible take place in English.
4. To the extent possible, all requests for information, responses to requests for information, exchange of information, notices and consents provided pursuant to this Memorandum will be in writing

Further Cooperation

1. The Authorities will discuss other ways of cooperation between themselves in the prevention, detection and deterrence of money laundering and terrorism financing

Amendments

1. This Memorandum may be amended at any time by mutual consent. The Authorities will communicate their consent to the amendments by exchange of written notification. Amendments will take effect on the date of the last notification.

Termination

1. This Memorandum may be terminated at any time by giving written notification to the other Authority. The termination will become effective as from the receipt of the written notification from the other Authority.
2. The termination of this Memorandum will not adversely affect the rights and commitments arising from or based on this Memorandum before or up to the date of such termination. The provisions relating to confidentiality of the information received prior to the termination of this Memorandum will continue to have effect after the termination of this Memorandum.

Effective Day

1. Each Authority will notify the other Authority in writing of their approval of this Memorandum. This Memorandum will become effective on the date of the later of the two notifications.
